Terms of use

These terms are an agreement between you and Airplane Mode, LLC, a Delaware limited liability company ("we" or "us"). They cover your use of Unyap, our iPhone app for speaking practice, and the service behind it. By using Unyap you agree to these terms. If you don't agree, don't use Unyap.

1. The app licence and these terms

Your licence to use the Unyap app comes from Apple's standard Licensed Application End User License Agreement (the "Apple EULA"): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

These terms cover the Unyap service: your account, the scoring and feedback, and your subscription. Where these terms and the Apple EULA differ about your licence to the app itself, the Apple EULA applies.

2. Who can use Unyap

You must be 13 or older to use Unyap. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you.

Unyap records only on iPhones that can transcribe speech on the device. On other iPhones it can't record takes.

3. Your account

You sign in with Apple, with Google, or with your email address and a one-time code. You are responsible for what happens on your Unyap account, so keep the account you sign in with secure.

You can delete your account at any time in the app under Settings > Delete account.

4. Subscriptions

Unyap needs a subscription. There are two plans:

• Yearly, with a free trial.
• Monthly.

The App Store shows the price in your currency before you buy.

• Apple sells the subscription and charges your Apple ID. Payment is taken when you confirm the purchase or, for the yearly plan, when the free trial ends.
• Your subscription renews automatically until you cancel. Cancel at least 24 hours before the trial or the current period ends to avoid the next charge.
• You cancel and manage your subscription in your Apple ID settings. In the app, Settings > Manage subscription takes you there.
• Apple handles billing and refunds under its own terms. Refund requests go to Apple.
• If your subscription ends, you can still see your past takes and scores, but you can't send new takes until you subscribe again.

Deleting your account does not cancel your subscription. Cancel it in Manage Subscription first if you want to stop being charged.

5. Using the service

Unyap gives you a topic, records you talking about it, and scores the take on our server. There is a daily limit on how many takes an account can send. We may add, change or remove features.

You agree not to:

• record other people without their permission;
• use Unyap to break the law, or to record content that breaks the law or someone else's rights;
• try to reach other users' data, or parts of the service you aren't meant to reach;
• get around the subscription, the daily limit or any other limit;
• send takes with bots or scripts, or overload or interfere with the service;
• sell, share or resell access to your account.

We may suspend or close an account that breaks these rules.

6. Your recordings

You own your recordings and what you say in them. You give us permission to store, process and analyze your takes, and to share them with the companies that run parts of Unyap for us, only to provide Unyap to you, as the privacy policy describes. This permission ends when you delete your account, apart from the copies the privacy policy says may remain for a limited time.

7. AI feedback

Your scores and feedback come from our measurements and from AI, and they can be wrong. They are practice feedback for everyday speaking and are not professional advice of any kind, including speech therapy, medical, legal or career advice. Check with a qualified person before you rely on them for anything important.

8. No promise of results

We don't promise that your score will go up, that your speaking will improve, or that Unyap suits any particular purpose. The score is our own method, and we may change how it works.

9. The service is provided as is

To the fullest extent the law allows, we provide Unyap "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Unyap may be unavailable at times, and we don't warrant that it will be error-free or that stored data will never be lost.

10. Limitation of liability

To the fullest extent the law allows, Airplane Mode, LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of Unyap. Our total liability for any claim about Unyap is limited to the amount you paid for Unyap in the 12 months before the claim.

Some places don't allow these limits, so some of them may not apply to you. Nothing in these terms takes away rights you have under the consumer laws where you live.

11. Ending your use

You can stop using Unyap and delete your account at any time. We may suspend or end your access if you break these terms, or if we stop offering Unyap.

12. Governing law and disputes

The laws of the State of Delaware, USA, govern these terms, without regard to its conflict of laws rules. Any dispute about these terms or Unyap goes to the state or federal courts in New York, New York, USA, and you and we agree to those courts' jurisdiction.

13. Changes to these terms

We may update these terms. We'll post the new version here with a new effective date. If you keep using Unyap after that date, the new terms apply to you.
